檢方起訴指出，蕭姓包商（56歲）去年5月承攬某公司位於小港區水庫段的土地開發工程，發現該地段地質屬咾咕石，為礦業法列管之石灰石，未經許可即以挖土機持續挖取該處之石灰石，嗣因當地經大規模開發，影響候鳥棲息生態，經高雄市野鳥學會告發後，循線查知上情。
案經高雄市經發局移送偵辦，檢方偵查認為，經濟部礦物局行文證實該地開挖及堆置土石為石灰石礦，而蕭姓包商未經許可即開挖，檢方因此將蕭姓包商依違反礦物法非法採礦罪起訴。
