33歲林男去年與A女在網路上結識，2月間A女跟家人吵架後，就跑到中壢區龍昌路找林男借住在林男的住處，檢方說，A女與林男在房間內獨處時，林男脫掉A女的衣褲，過程中A女一度掙扎拒絕，所以A女父親事後就向中壢警分局報案。
檢方調查，A女雖一度掙扎拒絕，但林男告知她「你可以當我的女友！」A女就同意與林男發生性關係，並非被強迫，雖然A女後來考量到林男的經濟狀況以及林男並非真心跟她交往，才自行搭車離開，但期間雙方仍發生多次性行為，難以認定林男有妨害性自主的犯行。
