〔記者周敏鴻、吳政峰、許倬勛／綜合報導〕司法官第49期的桃園地院法官何宇宸，審理前中壢市代會副主席劉威德涉及公職人員選舉罷免法案件時，被劉質疑以羈押方式逼被告供出其他被告的手段可議，向法院聲請迴避，何獲知裁准迴避後曾稱，絕未以交保和威脅押人方式取供，也沒有已為有罪心證認定，並稱有錄音為憑。
雖然何宇宸堅決否認，但法官評鑑委員會詳細過濾開庭錄音後打臉何宇宸，認為他對被告的說法，分明就是「提示」要押人取供，不供出其他被告犯行就押，供出就不押，也以不給停押具保手段逼迫另一被告。何見情勢不利，至此才稍作承認，表示日後會改善。
移送人審會 請假未回應
至於被聲請迴避審案，當時桃園地院合議庭勘驗審判卷證、錄音後，也認為何宇宸「已為有罪心證認定，不適後續審判」，遂裁准迴避。
何宇宸昨請假，未回應法評會的決議。
