周男偵訊表示，父親因中風約4、5年前住進榮民之家，但生活仍可自理，不料妹妹因精神狀況不佳，多次探望父親時都與護理人員起爭執，造成榮民之家困擾，去年2月24日，父親不慎摔倒骨折，榮家協助將父親送醫治療，因怕妹妹又造成醫院困擾，才沒有告知。
檢察官認為，周兄僅是未告知周女其父在何處就醫，並未對周父施以任何強暴、脅迫行為，認周男行為未構成強制罪犯罪要件，因罪嫌不足不起訴周男。
