26歲溫姓男子去年2月25日開車載女友，在苗栗縣頭份市民族路路邊停車時，與22歲機車騎士張姓男子碰撞；張男右腳骨折送醫，車禍38天後肺栓塞不治，張母控訴是車禍導致，溫男認為事隔月餘，與車禍無關。檢警解剖詳查，認定張男因車禍傷勢產生血管血栓，致肺栓塞而死亡，有相當因果。
解剖認定「由於死者下肢外傷骨折及因行動不良原因，會造成及容易導致下半身血管內血栓形成，並循環至肺動脈內導致」。另外，車禍發生當下，溫男女友頂替為小客車駕駛，接受警方筆錄偵訊，經張母過濾監視器畫面發現頂替；對於此部分，檢察官審酌溫男女友因一時失慮才犯案，犯後懊悔，裁定緩起訴處分，緩起訴期間為1年，溫男女友應支付張母12萬元損害賠償。
