林姓男子去年5月間晚間6點多，騎車途經基隆市中正區北寧路段時，失控自撞路旁小貨車左後車尾；因撞擊力道大，林因顱內出血、顏面與左上肢骨折，傷重不治。林的家屬控訴陳姓小貨車違停害死林，控告陳過失致死罪。
基隆地檢署調查，林事故時，血液的酒精濃度高達每分升224.2毫克，換算呼氣酒測濃度達每公升1.10毫克。另根據監視器畫面行車狀況顯示，林當時的時速約60公里，已遠高於機車慢車道40公里限速。
處分書指出，陳的小貨車違停雖有失當，但小貨車並未占到車道，左側車身離機車慢車道上還有0.3公尺距離。
檢方因此認定，林若沒有酒駕、超速，應不會發生自撞事故，死因與陳違停無因果關係，遂處分陳不起訴。
