判決書指出，陳知悉何姓友人所開房屋仲介公司遭人檢舉逃漏稅，佯稱須罰款5倍，亦即500萬元，但他可用300萬元解決，陸續騙走78萬元，後來會計師算出只要罰42萬，何男才驚覺受騙。
陳男則說，已於去年1月持何男所交付繳費單繳納勞保費用等共計4萬多元。
最後法官以何男被騙金額78萬元，扣除陳男已繳的4萬多元，判陳仍應賠償73萬餘元。
