起訴書指出，住在台中市西屯區長安路李男與梁某是鄰居，但僅因細故，李男對梁某懷恨在心，已經多次騷擾梁某，兩人的關係非常緊張，2018年2月20日晚上9時許，李男丟了1支點燃的仙女棒，然後丟在梁某家門口，隨即躲回家裡。
梁男從監視器發現火光，出門查看已經不見蹤影，提供監視器畫面給警方。而被告在警訊中坦承丟仙女棒，但是在檢察官偵訊有翻供，據被害人提供之監視畫面，應是被告無誤。
審酌被告所丟至仙女棒的地點並無可燃物，難認有放火之故意，且兩造之間並無深仇大恨，只是一些細故相處不睦，應無放火之犯意，其行為應構成恐嚇危安，依法起訴。
