檢察官偵訊時，黃男（43歲）坦承持空氣槍至醫院急診室開空氣槍開槍，又有醫師、護士指證，檢方以他曾犯竊盜、性騷擾被判刑，五年內再犯有期徒之罪，為累犯，遂請法官加重其刑。
起訴書指出，黃男於6月27日上午，不具殺傷力的空氣槍前往台中市中區平等街澄清醫院平等院區，未經掛號直接闖入平等院區急診室許姓醫師急診診療室。
黃男持空氣槍朝地面扣扳機兩次擊發，並將護士及其他病患趕出急診室後，要求許姓醫師開立診斷證明書證明他精神狀況正常，以報考國家考試，妨害許姓醫師及侯姓護士執行醫療業務，經醫護人員發現報警查獲黃男，並扣得空氣槍。
