「農業發展條例」第18條明定，興建農舍不得影響農業生產環境及農村發展，如果農舍蓋在鄰路鄰側，其他10分之9才能農用。
農委會水保局副局長林長立指出，目前全台各地方縣市政府都依此執行，如果宜蘭縣對申請興建農舍的農民未依規定審查，是違法、不允許的。「農舍是特許，不是有農地就可以蓋農舍。」
