檢方起訴內容指出，陳姓女子去年1月14日清晨6點49分，騎機車行經九如一路、臥龍路口，疏於注意「轉彎車應禮讓直行車」，造成擦撞同向的蔡姓男子機車，造成蔡男人車倒地，左膝受傷，經送醫後返家，蔡男卻在隔月27日上午在三民區住處過世，蔡妻為此控告陳女過失傷害致死。
不過，檢方會同法醫調查，認定蔡男死因無關車禍，是生前舊疾引發常堵塞敗血性休克的「自然死亡」，因此僅將陳女依過失傷害罪嫌起訴。
