〔記者顏宏駿／彰化報導〕彰化縣鄭男去年12月8日、10日開車經過彰化市「台74甲線（彰東外環道）」時超速，被路邊取締超速的警察拍照告發，2件共被罰3200元，但鄭男認為，該處雖有「測速取締」標誌，但已被路樹擋住，他認為警方違法取締在先，因此提出申訴，該案經彰化地院審理，法官認定鄭男勝訴，撤銷原處分。
該路段速限為70公里，但鄭男經過時分別開到時速86、85公里，超速15公里，每件罰1600元，2件得繳交3200元罰金。
警方在現場立於標誌後方100公尺，以雷達測速儀採證，事後開單告發，但鄭男在被拍照時已有所警覺，折返現場，發現該處中央分隔島雖有「前有測速取締」標誌，但該標誌因道路養護單位疏於修剪而遮蔽。
警方雖辯稱現場並無樹木遮蔽，但法官發現警方在事後卻行文公路局彰化工務段進行修剪。
法官認定，鄭男所訴有理，因此撤銷原處分。
