豬肉攤商是薛男的前老闆，檢方說，他於薛男離職後，發現冰庫的豬腳短少，懷疑是被他解雇的薛男所為，2015年7月26日決定埋伏逮人。
豬肉攤商埋伏許久，等到薛男騎著機車到豬肉攤前停下，豬肉攤商就上前抓住薛男並報警，警方說，豬肉攤商指控薛男計畫要偷取冰庫內的豬腳，薛男才因涉嫌竊盜未遂被送辦。
檢方調查，當時薛男騎著機車停在豬肉攤前，沒熄火、沒下車，就被豬肉攤商抓住。因豬腳放在冰庫內、冰庫位於攤位內，薛男若沒下車，就沒有偷竊豬腳的可能性，加上沒有其他積極證據認定薛男有竊盜未遂的犯行，犯罪嫌疑不足，已予薛男不起訴處分，不得再議。
