檢警調查，去年10月25日晚上6時30分，吳男帶著江姓女友從公車循環站搭乘302路線往基隆中山高中方向，他趁公車起動身體隨之搖晃的時候，將身體向後退，連續伸手摸小美臀部，小美當場嚇得尖叫，並在附近的烏橋頭站下車，通知男友一同前往警察局報警。
檢察官偵訊時，吳男坦承犯案，檢方依涉嫌違反性騷擾防治法將他起訴。法官審理期間，吳男與小美已達成和解，小美因而撤回告訴。
