〔記者周敏鴻／桃園報導〕桃園市林姓男子在中壢區一處房屋仲介公司擔任業務員，去年4月間，他收取陳姓男子10萬元斡旋金，答應幫對方購買中壢區一處房屋，結果房屋沒買成，他還把10萬元斡旋金花用光了，被桃園地檢署依業務侵占罪嫌提起公訴。
檢方調查，林男（41歲）知道陳男想要購買中壢區一處社區的房屋，就於去年4月1日，先向陳男收取5萬元斡旋金，並簽訂合約「未於同年月30日前，為陳男談妥上開房屋買賣，即應將斡旋金退還」。
2個星期後，林男又找上陳男再收5萬元，理由是斡旋金應為10萬元，陳男必須補足，檢方說，陳男不疑有他，又拿5萬元給林男，並收取林男簽立的「房屋仲就有限公司入帳單」一張。
檢方說，去年5月1日，陳男因買屋不成，找上房屋仲介公司，要求林男退還10萬元斡旋金，才驚覺錢早就被林男花光。陳男雖討回3萬元，但仍有7萬元要不回來，才會報警，林男涉嫌業務侵占的罪證明確，已將他提起公訴。
