所謂「袋地」，指的是沒有道路可通行的土地。張錦昌表示，屏東地院強制執行刨除道路並讓地主圍籬，是考量居民還有其他道路可通行，只是其他2條道路地主也封路，才造成居民無路可走，這時可向法院聲請暫時狀態假處分，裁定居民如何通行，或強制其他2條道路之一給居民通行；不過地主對袋地通行權有要求租金的權利，因此還是要付出一點代價。
張錦昌認為，鄉長選擇拆除法院強制處分的圍籬已涉毀損罪，未來可能挨告，但因涉及住戶的緊急避難權，鄉長作法是否適當，將來由法官來裁定。（記者葉永騫）
