一名廖姓副店長2017年5月間在店裡時，涉嫌持手機碰觸女店員臀部，一審被依違反性騷擾防治法，判處拘役20天，他不服提出上訴。橋頭地院法官發現廖男確有以手機往店員臀部方向快速劃過，認定他的辯解毫無可採，因此駁回上訴。
判決書提到，廖男不否認有和女店員一起共事，但矢口否認性騷擾犯行，辯稱「是碰觸腰部，並未碰到臀部」。不過，法官調查發現他確有以手機往臀部方向快速劃過的事實，也經檢察官勘驗現場監視錄影畫面，因此他的辯解毫無可採，所涉性騷擾犯行，事證明確。
法官審酌廖男在工作場所，不思尊重女性職員，率以手機觸碰臀部性騷擾，欠缺尊重女性身體自主權，造成女職員感到不舒服及身心受創，雖有傳送訊息道歉，但至今未能取得對方諒解，原判決量處拘役20日，可易科罰金，並無不當，駁回上訴。
