判決指出，去年10月間，林姓男子結識小娟，兩人交往不到1個月，小娟就被林男帶回家過夜，當晚連續發生3次性行為；小娟事後言行有異，家屬追問下，小娟坦承交男友，還跟對方發生性行為。
家人帶著小娟前往醫院驗傷，林男同意分期拿出30萬元和解，只求對方不要提告，獲小娟家人同意，但林男只繳了第一期的金額後就賴帳，還避不見面，小娟家人因而提起性侵告訴。
法官開庭發現，林男曾有過妨害性自主前科，曾被判刑4年4月定讞，出獄才2年多，又犯下性侵案，雖然他深感悔意，但仍屬累犯，判他徒刑3年6月，全案可上訴。
