檢調去年12月查出周泓旭涉嫌吸收新黨青年軍王炳忠等人，認為該案與周泓旭吸收外交官未遂一案有「裁判上一罪」之關係，因此將周移請高院併案審理，不料遭高院裁定駁回，高檢署針對此部分也已提起上訴，現由最高法院審理中。
