吳妻提告指出，李女臉書私訊傳送與老公口交的性愛影片給她，聲稱兩人多次在家中發生性行為，她才得知老公外遇，怒告兩人去年4月至8月間，多次在住處嘿咻。
庭訊時，李女說，吳男告訴她尚未辦理結婚登記，不知對方已婚身分，僅坦承兩人去年6月在新北市中和區汽車旅館嘿咻過1次；吳男也說，兩人就只發生過那麼一次性行為，沒想到李女就懷孕，交往時，李女就已知悉他的人夫身分。
檢方調查，李女雖曾私訊吳妻，聲稱與吳男多次在吳妻家中嘿咻，但這部分沒有影片佐證，認為李女不滿吳男遲未離婚，而傳訊向元配示威，內容有加油添醋的可能，又影片內容僅有李女替吳男口交，並無兩人性交畫面，因此依自白，認定兩人僅發生過1次性行為。
