判決指出，蔡男2015年3月19日中午12點2分在新竹市麥當勞搭訕小彩，小彩離開餐廳後，兩人又在便利商店碰到，蔡男藉機邊走邊聊鬆懈小彩戒心，帶她到百貨公司殘障廁所內，先把廁所門上鎖，接著掀起小彩上衣，再解開她的內衣扣環，撫摸胸部和強吻，還脫掉小彩外褲，把手伸進小彩內褲，對小彩下體摳摳摸摸，還強拉小彩的手摸她生殖器。
小彩哭求彩蔡男停止，蔡男才罷手離開，小彩遂到百貨公司服務台求助並報警。
蔡男辯稱沒有性侵，只承認撫摸小彩下體和胸部及強吻，還說經過小彩同意，一審新竹地院採信蔡男辯詞，依強制性交未遂罪判處2年徒刑，但上訴高院後，合議庭參考蔡男在審檢歷次供詞，認為他確曾用手指摳小彩下體，已算性侵，因此改依強制性交罪論處，考量雙方已和解且小彩願意原諒蔡男，因此判處蔡男3年4月徒刑，還可上訴。
